WHAT IS THE IM TOW FEE REGULATIONS FEASIBILITY STUDY?
House Bill 1, passed in the 82nd Texas Legislative Session (2011), requires the Study of Nonconsent Towing Fees and Compliance with Local Consumer Regulations (“Services”).
Texas Department of Licensing and Regulation (TDLR) has been charged with hiring a consultant firm to provide recommendations, strategies and options the State may consider with regard to towing fees and regulation. The firm selected to conduct this study is Morningside Research and Consulting, Inc.
The study to be performed is to include, but not limited to, the following:
• the fees charged for motor vehicles towing services related to incident management towing,
• the feasibility and effects of the implementation of a fee schedule or establishment of a maximum fee for motor vehicle towing services,
• the terms and timing of payment to incident management towing companiesfor towing services including payment for the release of semitrailers and other motor vehicles, and
• the identification and evaluation of any other relevant aspect of incident management towing that may arises in the course of conducting this study.
06/29/2012 - Finish gathering tow tickets for review and for future analysis.
06/29/2012 – Interview and Survey IM Tow Companies
07/31/2012 - Finish collecting local regulations from Municipalities and Counties
08/31/2012 – Analysis of IM Tow Company data ends.
09/30/2012 – Drafting of Report on IM Tow Regulations Feasibility Study begins.
10/31/2012 - Draft of Report is due to TDLR for review
12/07/2012 – Final Report is due to TDLR
January 2013- TDLR will present final report to the 83rd State of Texas Legisture
